You will find information on Delivery, Returns and Your Account on other pages of the site and those pages shall be incorporated into these terms and conditions. If you have any questions, please contact us by using the “contact us” form. In these terms and conditions, “we”, “us”, “our”, “H&I” and Hamilton & Inches refer to Hamilton & Inches Ltd. Please read these terms and conditions carefully before using the site. By accessing the site and/or placing an order, you signify your agreement to be bound by these conditions and you consent to us using your information in accordance with our privacy policy. If you do not accept these terms, please do not use the site. You must use the site for lawful purposes only. If we allow you to register with us you are fully responsible and liable for all access made to the site using any password or user name that you register with us. You should keep such passwords and user names confidential at all times. Your use of and registration on the site is void where it is in breach of these Terms and Conditions.
Purchasing and Title
If making a purchase from this site using a credit card you must be 18 years of age or older. In all circumstances you must have the authorisation of the card holder of the card being used before making a purchase from www.hamiltonandinches.com. Orders are accepted at Hamilton & Inches sole discretion. An order will be deemed to have been placed when you ‘Submit Order’ from the final Review Order screen. You will receive an email to acknowledge receipt of the order. An order becomes a ‘Confirmed order’ and is per se accepted when payment has been successfully received through Worldpay, after which goods will be despatched at the earliest opportunity. If payment is unsuccessful you will be notified within 24 hours, Mon – Fri. Worldpay is part of the RBS group and acts as a payment facilitator. Rejection of a credit/debit card payment is being made by the card issuer and neither Hamilton & Inches nor Worldpay can be held liable. Where items have gone out of stock you will be notified, so that you can decide whether to await their availability or have your credit/debit card refunded. In no circumstances are Hamilton & Inches liable for any other charge or cost. Title to the goods you purchase will pass to you once we have received cleared payment in full for them and they have been successfully delivered to you. Until that time we will retain title to the goods.
Engraving service
Hand engraving on specific products is available online. Please read the directions carefully at the time of placing the engraving instructions, as items that have been engraved cannot be refunded or exchanged unless the goods can be shown to have been defective at the time of delivery. Engraving adds a minimum of two weeks to the published delivery times.
Product Definitions and Descriptions
Silver means 925 Sterling Silver unless otherwise stated.
Gold refers to 18 carat yellow or white gold unless otherwise stated.
Handmade silver is made by Hamilton & Inches’ workshop located at 87 George Street unless otherwise stated.
Diamond weights refer to the total carat weight for the item unless otherwise stated. Diamond set jewellery invariably has the diamond weight calculated with the stones already set and a minimal variance to the published weight may exist.
Hamilton & Inches adheres to the Kimberley Process with regard to the sourcing of diamonds and has received written assurances from its suppliers that they do likewise.
Dimensions given are approximate as the handmade nature of the items we sell means that each is individual and subject to variances.
Delivery and Customs
Please see our Delivery Information page for information on timings and the costs of delivery. We will use our reasonable endeavours to deliver the goods or services within the times indicated. However, where delivery times and dates are given, they are for general guidance only and we cannot be held liable for late delivery of goods as a result of circumstances beyond our control. It is important that the address supplied to us by you is accurate. We intend to deliver the goods to the address you have provided. You are responsible for making arrangements to receive the goods. Where goods become held at the post office or other delivery company’s depot because no one was available when the goods were delivered it is your responsibility subsequently to collect the goods. We are not able to deliver to P.O. Boxes. Please note that any customs duty and/or administration charges incurred by your parcel being delivered overseas will need to be settled by you. Hamilton & Inches will not be held liable for these.
Making Returns
To return items you must obtain a Return Authorisation number and follow the instructions provided. A Return Authorisation must be secured within 7 days but you then have up to 28 days from the date of purchase physically to return the item. Please see the Returns Policy to find out more. All items of jewellery must have their security tag still in place.
Items that have been engraved cannot be refunded unless they are defective or faulty.
Purchases made via the Internet or via Mail-Order cannot be returned to one of our shops. Items being returned should be sent, with the correct paperwork, to:

EH2 3EY When returning items you are strongly recommended to obtain proof of posting. We cannot accept responsibility for parcels lost in transit. A refund of the price of the goods will be made on receipt of the item in compliance with the Returns Policy. For all returns, except where the item is faulty or dispatched in error by us, you will be required to arrange and pay for the return of the products to Hamilton & Inches.
Cancellations and exchanges
If you realise you have made a mistake and wish to cancel your order, please contact us as soon as possible using info@hamiltonandinches.com. In all other circumstances follow the Returns Policy shown elsewhere.
If we have given engraving instructions we cannot cancel your order if we have already started the work.
Payment Security
We accept VISA, MasterCard, Maestro, Delta, Electron and Solo.
To receive your payments over the Internet securely we use Secure Sockets Layer (SSL) technology, which is the standard Internet practice and means your details are protected. You can see that you are in a secure environment through the ‘padlock’ symbol on Microsoft Internet Explorer or ‘key’ symbol on Netscape Navigator. SSL works with Microsoft Internet Explorer version 3.0 and later versions/ Netscape Browser versions 2.0 and later versions. Please do not send orders via email, as we cannot guarantee any secure transmission of your details. In using the online order process we shall take all reasonable care to keep your order and details secure, but in the absence of our sole negligence we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data (including credit and account details) you provide when accessing or ordering from the site. Defective and damaged items
If you should receive an item you have ordered that is defective, damaged or not what you ordered, please contact us as soon as possible. If you have a valid claim in respect of any of the goods which is based on any defect in the quality or condition of the goods, at our sole discretion, we shall resolve any issues as quickly as possible by delivering another item, replacing your order or refunding the amount paid.
Contract Terms
Goods supplied are not for resale. These terms and conditions cannot be varied except by changes made by Hamilton & Inches which we may make from time to time and publish on the site. Changes to the terms and conditions will be apparent to you when you log onto the site for a new session. Your continued use of the site after such notification shall be taken as your full acceptance of such changes. To the extent permitted by law, our liability to you in connection with any claim or series of connected claims under these terms and conditions shall not exceed £1,000 or the value of the goods to which a claim is relevant, whichever is the greater.
Notwithstanding anything else in these terms and conditions, we do not exclude or limit our liability in respect of death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
These terms and conditions do not affect your statutory rights as a consumer.
This site and its contents will not constitute the basis for any contractual commitment between Hamilton & Inches and any prospective customer in any jurisdiction in which the solicitation of interest or the offering of or sale of products by Hamilton & Inches would contravene any applicable local, regional or national legislation.
We reserve the right to change, modify, substitute or remove without notice any information on the site without notice. We will endeavour to ensure that all descriptions and illustrations of the items on the site or elsewhere are accurate but there may be slight variations due to print and publishing limitations.
Hamilton & Inches cannot guarantee that this site and its contents are completely free of technical errors, viruses or anything else that may have a harmful effect on any technology. We will endeavour to allow uninterrupted access to the site but access may be suspended, restricted or terminated at any time. By using this site, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this site. In no event shall H&I be liable for any indirect loss, consequential loss, loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with the terms and conditions or use of the site save where such liability cannot be excluded by law.
These Terms and Conditions shall be governed by and construed in accordance with Scots Law and any disputes that may arise will be subject to the exclusive jurisdiction of the Scottish Courts.
